India confident of direct access to Headley within 30 days - 4/5/2010

US Ambassador Timothy Roemer will meet Home Minister P Chidambaram on Monday evening to discuss India's access to David Coleman Headley.

Sources say that India has been assured by the US Justice Department that it alone will decide whether India can quiz Headley directly about his role in 26/11 and other attacks in the country.

In a plea bargain last month, Headley accepted that he was guilty of planning and executing bombings at public places in India, including 26/11, on behalf of the Lashkar-e-Toiba (LeT).

In return, American officials agreed that the death penalty would be waived for him, and that he would not be extradited to India.

Indian intelligence officials have been given mixed signals by the US about whether they can question Headley directly.  His plea bargain obliges Headley to testify in proceedings like India's 26/11 trial.  However, Roemer surprised India last month by announcing that no decision had been taken on whether India could interrogate Headley directly.

Roemer's statement came after US attorney General Eric Holder phoned Chidambaram to assure him that India would get the access it wanted to Headley, a Pakistani-American who made multiple trips to India between 2006 and 2008 to survey the places that would become the sites of the 26/11 attacks in Mumbai.

Sources say that India will take a week to finalize its official written request for access to Headley, and that the Home Ministry is confident of getting access to Headley within 30 days.  India's request will be sent to the US Justice Department who will then pass it on to the judge hearing the Headley case in Chicago.

Hyderabad police question Shoaib Malik - 4/5/2010

The Hyderabad police questioned the Pakistan cricketer a day after an FIR was lodged against him by Ayesha's family, accusing him of cheating.

Police on Monday morning reached the residence of tennis star Sania Mirza, where the Pakistan cricketer is putting up. A case of cheating case was lodged against him by the father of Ayesha, the Hyderabad girl who claims to be his wife.

In fresh trouble for 28-year-old Shoaib, who is scheduled to get married to 23-year-old Sania here on April 15, the Hyderabad Police have alerted the immigration authorities about the criminal complaint, a move that could pose difficulties for Shoaib to leave the country.

There was no immediate official word on why the police have gone to the Mirza residence.

The charges against Shoaib are that of harassment of Ayesha, cheating to marry another girl and criminal intimidation including threats to her to keep quiet, Hyderabad Police Commissioner A K Khan said.

Ayesha's father Mohammad Siddiqui in his complaint, which was lodged hours after Shoaib yesterday confirmed his marriage with Sania, had accused the Pakistani cricketer of cheating his daughter.

The Banjara Hills police said that a case under Sections 420 (cheating), 498-A (dowry harassment) and 506 (criminal intimidation) of IPC has been registered against Shoaib and they will take up the investigation after verifying facts of the complaint.

Shoaib, who landed here on Saturday, admitted to his 'nikah' with Ayesha but claimed the marriage was invalid.

Shoaib accused Ayesha of cheating him as he believed the girl he was marrying was the one in the photographs sent to him by her.

Khan said an FIR has been made out and it would be followed by collection of evidence and taking legal advice since Shoaib is a Pakistani national.

"The Banjara Hills police have received a complaint by Ayesha Siddiqui against Shoaib Malik. We have registered a case against Shoaib. Now we will take legal opinion quickly before taking further action," Additional Commissioner of Police (Co-ordination), Dwarka Thirumala Rao said.

He said there were some legal complications involved in the case and they "will have to examine whether a foreigner committing an offence on a foreign soil comes under the purview of IPC or not".

"The legal opinion will be taken quickly and we will proceed further as the marriage is on April 15," he added.

Her husband converted sons to Islam without asking her - 4/5/2010

Through most of their 17-year marriage, M. Indira Gandhi and her husband observed rituals that she considered integral to their Hindu faith, she says. Each morning they would pray before a shrine, and on Fridays they would fast. During festivals they wore brightly colored, traditional outfits to attend their local temple.

Those were traditions Gandhi, a kindergarten teacher in the town of Ipoh, Malaysia, assumed they would be passing on to their three young children.

But nearly a year ago, she was stunned to discover that her husband had converted to Islam. Her surprise turned to anger when she discovered that, without consulting her, he had also converted their children - and he then won custody of them through the ruling of an Islamic court.

"If he wants to convert, OK," Gandhi said. "But these are children that were born from both of us."

Her husband's actions have left Gandhi navigating the conflicting jurisdictions of Malaysia's religious and civil courts in a case that has challenged the authority of Islamic Shariah courts in this predominantly Muslim country.

Under Malaysia's two-tier judicial system, Shariah courts handle family law cases involving Muslims, while secular courts handle those involving non-Muslims. But the lines have become blurred in cases involving interfaith disputes. Religious minorities have complained that they are at a disadvantage when their cases fall to an Islamic court.

The court ruling granting Gandhi's husband, Muhammad Ridzuan Abdullah, custody of their children came last year. But last month, in what some called a landmark ruling, a civil court overturned the Shariah court's decision and transferred custody back to Gandhi. On Thursday, Ridzuan failed in his bid to obtain a stay order on that ruling.

On Friday, Gandhi asked the court for permission to contest the children's conversion. The Ipoh High Court is scheduled to hand down its ruling on April 30.

One of her lawyers, K. Shanmuga, said he could not recall an instance when a civil court had overturned a child's conversion to Islam.

Lawyers say they have seen an increasing number of cases in recent years in which one parent, typically the father, has converted to Islam and converted the children without the other parent's knowledge.

Once they are converted and their identity card is stamped "Islam," there are far-reaching consequences. Shanmuga said children who are converted must study Islam at school and are subject to Shariah laws that state that Muslims cannot marry outside the faith, must raise their children as Muslims and cannot participate in non-Muslim religious ceremonies.

Malik Imtiaz Sarwar, a human rights lawyer and president of the National Human Rights Society of Malaysia, said he believed that some parents had converted their children to Islam to gain a "tactical advantage" in custody disputes.

In recent years, he said, civil courts have ruled that a convert to Islam is entitled to take a custody dispute to a Shariah court, even if the other partner is a non-Muslim.

Non-Muslims are not allowed to appear in Shariah court, and lawyers say such a court is more likely to award custody to the Muslim parent when the children have been converted.

Malaysia's Constitution says that the religion of a child under 18 should be decided by the parent or guardian. Some lawyers have argued that this should be interpreted to mean both parents, but the courts have not agreed, ruling that the consent of one parent is sufficient to convert a child to Islam.

Once a person has officially become a Muslim, it is difficult to change back. It requires permission from the Shariah court, but Shanmuga said there were no established criteria for renouncing Islam.

"Anybody who steps out of Islam, the Shariah court and the general Muslim population frown on," said Mohammad Hashim Kamali, an Islamic law expert and chief executive of the International Institute of Advanced Islamic Studies. "The procedures are not made easy for them."

Last year, the Malaysian Cabinet announced that it wanted to prohibit the conversion of children without both parents' consent. But no legislation has been passed to turn the Cabinet's decision into law, said M. Kulasegaran, the Democratic Action Party parliamentary member for Ipoh West and another of Gandhi's lawyers.

A spokesman for the Attorney General's Chambers declined to comment on the issue.

Hashim, the Islamic law expert, has recommended establishing a special court of mixed jurisdiction where both Shariah and civil judges would adjudicate disputes involving Muslims and non-Muslims on issues like child conversion and custody.

Malik said that when parents have sought redress in the civil courts over their children's conversions, the courts have generally ruled that such issues must be handled by the Shariah court.

He said recent rulings had followed the precedent set by the case of Lina Joy in 2007. Joy, who converted from Islam to Christianity, applied to Malaysia's highest civil court to have her conversion recognized. But the court ruled that conversion falls under Shariah jurisdiction. Joy has since left the country, Malik said.

While Gandhi's lawyers debate jurisdiction, Gandhi is focused not only on contesting her children's conversion but on being reunited with her youngest daughter.

Her eldest children, 12 and 13, have lived with her since she separated from her husband, but it has been nine months since she last saw her youngest daughter, who will soon celebrate her second birthday.

Despite the court decision awarding her custody, her husband had refused to return the girl as of Saturday.

"I missed a lot of her childhood," Gandhi said. "It's not about religion. It's about humankind. What does she know that she's been converted?"

UAE: Death sentence of 17 Indians is subject to appeal - 4/5/2010

Amid concerns here over capital punishment given to 17 Indians in Sharjah, UAE on Monday said its legal system guarantees fair trial and the death sentence is subject to appeal and annulment by the rule of law without any interference from the parties concerned.

"The UAE embassy in New Delhi has been following press reports with regard to convicted Indian nationals in Sharjah.

Death penalty in UAE legal system is subject to appeal and cassation by the rule of law without any interference from the parties.

"We fully trust our legal system and its procedures and we are sure that it will provide and guarantee a fair trial to the convicted," the UAE embassy in New Delhi said in a statement.

Moreover, the court (in UAE) provides lawyers for those unable to get legal help themselves and gives them the right and the means to defend themselves in court, it said.

Seventeen Indians were sentenced to death on March 29 by a Sharjah shariah court for allegedly killing a Pakistani and leaving three others injured in an attack last year.

External Affairs Minister S M Krishna has termed as "very unfortunate" the death sentence given to 17 Indians and has instructed his ministry to assist them in filing an appeal and also bear all the expenses involved.

MBA graduate allegedly gang-raped in car - 4/2/2010

Out for a job interview, a 25-year-old married woman in Pune was allegedly raped for hours after being abducted in a cab by three men on Thursday.
 
Two of the men have been arrested. Police said they had confessed to the crime. The third is absconding.
 
The woman, an MBA graduate who had returned from the US only a month ago, said she had a job interview and hailed a cab at Wakad at 4.30 pm. There were three men in the cab, but in Pune it is common to share cabs as the public transport system is poor.
 
The woman said the three unidentified men took her to an unknown location and gang-raped her till midnight.
 
The men then dropped her at an unknown location and she made her way to the Hinjewadi Police to register a complaint.
 
Two men have been detained by the Hinjewadi police in the case.
 
The woman's husband is in the US.

Pak govt tables Bill to clip Zardari's presidential powers - 4/2/2010

Pakistan President Asif Ali Zardari is set to lose his sweeping powers to the Prime Minister.

The government has introduced a constitutional Bill in Parliament transferring Zardari's powers to the Prime Minister and possibly ending months of political wrangling.

The set of reforms, known as the "18th Amendment Bill," is expected to be passed by Parliament, effectively turning Zardari into a titular head of state.
 
The President will lose powers like the authority to dissolve the national assembly and appoint military chiefs and the chief election commissioner.

The Bill also shifts Zardari's powers to appoint judges to a commission comprised of senior judges and government figures.

Encounter on in J&K; two more terrorists killed - 4/2/2010

Two Lashkar-e-Toiba militants were killed in a gunbattle with security forces in Rajouri district on Friday.

Acting on a tip off about the movement of militants in Kanthole Gundi-Darrutelna in Kalakote, 130 kms from here, police assisted by Rashtriya Rifle and CRPF personnel launched a cordon operation.

An encounter soon broke out around 0830 hrs in which two militants have been killed, police said.

Both of them are Pakistanis and believed to be a part of the group that infiltrated from across the border in Akhnoor on March 23.

With Friday's killing, 14 militants have been killed in the past one week in Rajouri district. All the slain militants belong to LeT.

Six LeT militants of Pakistani origin, who had escaped from Triyath forest after a brief encounter three days ago, were killed by security forces in Rajouri district on Thursday.
 
A search team of police assisted by army, special operation group (SoG) and CRPF tracked down the militants who had escaped from Triyath forest on March 30 following a brief encounter with the security personnel.

A jawan had been killed and Station House Officer of Daramshal Police Station Inspector Showkat Ali was injured in that incident.
 
Two militants of this group were killed in Dharamshal area on Saturday last while four were killed in Kandi Bhudal belt of Rajouri district on Wednesday.

Couple in jail asks for permission to get pregnant - 4/2/2010

They had been married for eight months and wanted a life a little more comfortable than what they were used to. So Sonia and Jasvir, both in their early 20s, decided to kidnap a 16-year-old from Hoshiarpur.

In 2005, they picked up the son of a local businessman outside his school. They asked for 50 lakhs in ransom, when the teenager's family didn't pay up, he was given sedatives that led to his death.

A court gave Sonia a life sentence, and the death penalty to Jasvir. Husband and wife are currently in the Patiala Jail.

Now, they're making headlines again. "Both have asked court that they be allowed to have conjugal rights in the jail itself. It has been allowed in many developed countries and is successful,'' says their lawyer, Gursharan Kaur.

Sonia says she wants to conceive before Jasvir is hanged.

''We have no example or no instruction on this. This has never happened before. They are in separate cells,'' says Jeevan Garg, the Superintendent of Patiala Central Jail.

The Punjab and Haryana High Court will hear the case on May 24.

If the court agrees to their request, and Sonia gets pregnant, it may also be up to the court to indicate what should happen to the couple's child. Available options include the child being raised in special prison facilities, in a government home, or by either set of grandparents.

Don't treat soldiers like beggars: Supreme Court - 4/2/2010

The Supreme Court has slammed the union government for treating army personnel like "beggars" in respect of emoluments and pension and asked the authorities to adopt a more "humane approach" towards those bravely defending the country's borders.

"If a person goes to any part of Delhi and sits for begging, he will earn Rs 1000 every day and you are offering a pittance of Rs 1000 per month for a man who fought for the country in the high altitudes and whose arm was amputated?

"Is this the way you treat those brave army officers? It is unfortunate that you are treating them like beggars," a bench of Justices Markandeya Katju and A K Patnaik said in verbal comments while passing the order.

The apex court passed the order dismissing the Centre's appeal challenging a Punjab and Haryana High Court direction to pay higher pension to C S Siddu, a Short Commissioned Officer whose right arm had to be amputated due to an accident while on duty at the high altitudes on November November 21, 1970.

"The army personnel are bravely defending the country even at the cost of their lives and we feel they should be treated in a better and more humane manner by government authorities, particularly, in respect of their emoluments, pension and other benefits," the bench said in an order.

There was an element of drama in the court when Additional Solicitor General Parag Tripathi pleaded with the court not to use "strong words" in the order like "beggars," "niggardly" "miserly", following which the bench dropped them from the written order.

"We regret to say that the army officers and army men in our country are being treated in a shabby manner by the government. In this case, the respondent (Sidhu), who was posted at a high altitude field area and met with an accident during discharge of his duties, was granted a meagre pension. This is a pittance (about Rs 1000) per month plus DA. If this is the manner in which the army personnel are treated, it can only be said that it is extremely unfortunate," the bench however, noted in its written order

Lalu says Ramdev 'senile', cheating people - 4/2/2010

RJD chief Lalu Prasad has flayed yoga guru Ramdev, who has decided to float a political party, for criticising every politician in the country and said it was nothing but madness.

"It is not good that Ramdev is criticising every politician in the country to prove himself good," Prasad told a function here yesterday.

"In fact, Ramdevji bauwra gaye hai (Ramdev has gone mad)," he said, adding that he had already told the yoga teacher not to launch any political outfit.

Prasad also criticised Ramdev for claiming to cure cancer. "In this research age, it is nothing but cheating and befooling people," he said.

Interestingly, Prasad had earlier defended Ramdev when CPM leader Brinda Karat had alleged that animal bones were mixed with ayurvedic medicines produced by Patanjali Yogapeeth, an institution established by Ramdev at Hardwar.
